Welcome to Diffusion Studio Inc. These Terms and Conditions (“Terms”) govern your access and use of our 2D motion graphics and video rendering library distributed as an installable package (the “Library”), as well as access to our web-based testing playground (the “Playground”). By using the Library or the Playground, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Library or the Playground.
1. License Grant
Diffusion Studio Inc. grants you a limited, non-exclusive, non-transferable, and revocable license to use the Library and access the Playground in accordance with these Terms. This license permits you to distribute the Library to third parties as part of its intended purpose, subject to compliance with the following conditions.

2.1 Permitted Distribution
You are allowed to distribute the Library to third parties, provided that:
The Library is included as part of a larger project, application, or system that utilizes its functionality.
You ensure the distributed Library retains its original copyright and licensing information, including any watermarks or notices indicating Diffusion Studio Inc. as the owner.
2.2 Prohibited Actions
When distributing the Library, you may not:
Modify or remove license validation mechanisms to enable unlicensed or unauthorized use.
Alter or obfuscate the Library's source code to bypass licensing or attribution requirements.
Misrepresent the Library as your own work or fail to credit Diffusion Studio Inc. appropriately
2.3 Liability for Distribution
You remain responsible for ensuring that any distribution of the Library to third parties complies with these Terms. Unauthorized use of the Library by third parties distributed by you may result in termination of your license.
3. Authentication Token and Licensing
3.1 Authentication Token Usage
To unlock the full features of the Library and remove the default watermark, you must obtain an authentication token. The authentication token must be validated via an HTTP request as part of the Library's operation. You agree to provide accurate and truthful information during the authentication token registration process.
3.2 Watermark and Attribution
If the library is installed via the public package registry, a watermark is displayed on all outputs. This watermark cannot be removed or altered without proper authorization and licensing.
4. Playground Use
4.1 Access and Purpose
The Playground is a web-based application that allows users to test the Library in combination with various machine learning models. It is available for both non-commercial and commercial purposes, provided that such use complies with these Terms.
4.2 Commercial Use
Users are permitted to use the Playground for creating outputs that are sold, distributed, or otherwise monetized.
4.3 User-Generated Content
By uploading or generating content in the Playground:
You represent that you own or have obtained all necessary rights to the content.
You grant Diffusion Studio Inc. a non-exclusive, worldwide, royalty-free license to process and display the content solely for the purpose of operating and improving the Playground.
5. Restrictions on Use
You agree not to:
Use the Library or Playground for any unlawful or unauthorized purpose.
Modify, copy, or create derivative works of the Library or Playground beyond what is expressly permitted by these Terms.
Distribute, sublicense, lease, or otherwise transfer the Library, authentication token, or access to the Playground to any third party in violation of these Terms.
6. Intellectual Property
The Library, Playground, and all associated intellectual property rights are owned by Diffusion Studio Inc. or its licensors. Distribution of the Library to third parties must include all original copyright and licensing information and must not misrepresent ownership of the Library. Unauthorized use of the Library or Playground is a violation of intellectual property laws and these Terms.
7. Privacy and Data Usage
7.1 Playground Data
Diffusion Studio Inc. may collect and process usage data from the Playground for operational and improvement purposes. For details on how your data is used and protected, please refer to our Privacy Policy.
7.2 Authentication Token Information
Information provided during authentication token registration will be handled in accordance with applicable data protection laws.
8. Limitation of Liability
To the fullest extent permitted by law:
Diffusion Studio Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use or distribution of the Library or Playground.
Diffusion Studio Inc.'s total liability for any claim arising out of or relating to these Terms, the Library, or the Playground shall not exceed the fees you have paid to obtain an authentication token, if any.
9. Termination
9.1 By You
You may terminate your use of the Library or Playground at any time by ceasing all use and deleting the Library, any related files, and any content generated in the Playground.
9.2 By Diffusion Studio Inc.
Diffusion Studio Inc. reserves the right to terminate or suspend your license and access to the Playground immediately if you breach these Terms or engage in unauthorized use or distribution.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of law principles.
11. Changes to Terms
Diffusion Studio Inc. reserves the right to update these Terms at any time. You will be notified of material changes through email. Continued use or distribution of the Library or Playground after such changes constitutes acceptance of the revised Terms.
